Terms of Service

1. Acceptance of Terms

These terms govern your access to and use of ComfortOS, the HVAC operations platform operated by Better Cards, LLC ("Better Cards," "we," "us," or "our") and available at company.getcomfortos.com. By creating an account, accessing a tenant workspace, or using any ComfortOS feature, you agree to these Terms of Service and our Privacy Policy.

If you use ComfortOS on behalf of a company, you represent that you have authority to bind that company. In that case, "you" refers to the company and its authorized users.

2. The Service

ComfortOS provides field service management, dispatch, customer records, invoicing, integrations, compliance tooling, and related features for HVAC contractors. Features may vary by subscription tier and tenant configuration.

Better Cards may modify, improve, or discontinue features with reasonable notice when changes materially affect paid subscriptions.

3. Accounts and Tenant Workspaces

Each HVAC contractor operates in an isolated tenant workspace. Tenant owners are responsible for user invitations, role assignments, and activity within their workspace.

You must provide accurate registration information and keep credentials secure. Notify us promptly of unauthorized access through the contact form at https://getcomfortos.com/home/contact.

• One tenant workspace per contracting business unless otherwise agreed in writing.
• Shared logins are prohibited; each user must have a unique account.
• Tenant owners may export their business data subject to applicable plan limits and law.

4. Acceptable Use

You may use ComfortOS only for lawful business purposes related to HVAC and home-services operations. You may not misuse the platform, interfere with other tenants, attempt unauthorized access, scrape the service, reverse engineer client-side code except as permitted by law, or upload malware or unlawful content.

SMS, voice, and marketing features must comply with TCPA, CAN-SPAM, 10DLC registration, and applicable state telemarketing rules. You are the sender of record for communications initiated from your tenant.

5. Customer Data and Privacy

You retain ownership of data you submit to ComfortOS, including customer records, job history, photos, and communications metadata. Better Cards processes that data to provide and secure the service as described in our Privacy Policy and Data Processing Agreement where applicable.

You are responsible for obtaining any consents required from your customers before collecting, storing, or messaging them through ComfortOS.

6. Third-Party Integrations

ComfortOS may connect to QuickBooks, payment processors, financing providers, telephony carriers, and other third parties. Those services are governed by their own terms. Better Cards is not liable for third-party outages, pricing changes, or data handling outside our control.

API credentials and integration tokens you provide remain your responsibility to safeguard and rotate.

7. Fees and Billing

Paid plans, transaction fees, and add-ons are billed according to the pricing presented at signup or in an order form. Unless stated otherwise, subscriptions renew automatically until canceled.

Overdue amounts may result in suspension after notice. Better Cards does not provide tax advice; you are responsible for sales tax, use tax, and contractor licensing compliance in your jurisdictions.

8. Intellectual Property

Better Cards owns the ComfortOS software, branding, documentation, and underlying technology. These Terms do not grant you ownership of our intellectual property.

You grant Better Cards a limited license to host, process, transmit, and display your data solely to operate and improve the service, including anonymized analytics that do not identify your customers.

9. Disclaimers

ComfortOS is provided on an "as is" and "as available" basis. Better Cards disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

Compliance features assist with EPA refrigerant logging, membership renewals, and record retention but do not replace professional legal, environmental, or accounting advice. You remain responsible for regulatory compliance in your operating areas.

10. Limitation of Liability

To the maximum extent permitted by law, Better Cards will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities.

Better Cards's aggregate liability arising from these Terms or the service will not exceed the fees you paid to Better Cards in the twelve (12) months before the event giving rise to the claim.

11. Termination

You may cancel at any time through account settings or by contacting support. Better Cards may suspend or terminate access for material breach, non-payment, security risk, or unlawful use.

Upon termination, you may request export of tenant data within thirty (30) days, after which Better Cards may delete data according to our retention schedule unless law requires longer storage.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules.

Informal resolution first. Before filing a claim, the parties agree to attempt good-faith resolution for at least thirty (30) days after written notice of a dispute is sent through the contact form at https://getcomfortos.com/home/contact.

Small claims. Either party may bring a qualifying individual claim in small-claims court.

Venue. Except where prohibited by applicable law, disputes arising from these Terms or the Service will be resolved in the state or federal courts located in Polk County, Iowa, and each party consents to personal jurisdiction and venue in those courts.

Individual claims only. To the fullest extent permitted by law, claims must be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. If this restriction is held unenforceable as to a particular claim, it is severed for that claim only and the remainder of these Terms stays in effect.
